Producers and Writers Need Better Legal Advice

Lawyers José María Cabral and Fernando Ramírez participated in the Dominican Global Film Festival panel on “Legal aspects in the distribution of cinematic works.”

(Santo Domingo, November 16, 2012) – Legal advice and consultation are fundamental in the drafting of all legal transactions and should be available from the very first moment of any creation, production and distribution of audiovisuals in order to protect the rights of filmmakers, producers and script writers, explained lawyers José María Cabral and Fernando Ramírez.

Speaking on the panel, “Legal aspects in the distribution of cinematic works,” which is part of the panel series offered by the Dominican Global Film Festival (FCGD), Mr. Cabral said the Film Law requires that the creation and realization of a work of art, from the moment of its existence, must be registered with the National Office of Authors Rights and the General Directorate of Film (DGCine).

He said that, although the Film Law in the Dominican Republic is less than two years in existence, it contributes to the preservation of the moral and patrimonial aspect of national productions. He explained that the moral aspects are related to the integrity, reputation and honor of the author whose rights are not transferable and are held in perpetuity. In terms of the patrimonial aspects, this deals with the marketing and distribution of the product.

Along these lines, Ramírez stressed that it is very important for producers and writers to research and secure the best legal advice they can before beginning to make a movie.

He said filmmakers generally don’t know about international standards, specifically in the United States and Europe where they can run into legal problems when it comes time to distribute their films. Also, this can significantly increase their production costs.

The attorneys also referred to the drawing up of contracts or transference assignments in the area of proprietary rights, diligence for investment in cinematic projects and the transference of rights for screening of audiovisual works. 

The panel was held on Friday November 16 in the auditorium of the Fundación Global Democracia y Desarrollo (FUNGLODE). Filmmakers, lawyers, writers, students and film lovers attended the panel.
